Except as otherwise provided herein, all antibody products (anti-sera, purified antibodies, monoclonal hybridoma cell lines, et al) and any derivative or byproduct thereof, resulting from the efforts of AbMART and funded by customers shall be the sole and exclusive property of customers. However, It is understood that AbMART has in the past and shall in the future conduct research and development funded independently of customers in the field of generation of antibodies and antibody products. All ideas, inventions, and discoveries in any field, whether patentable or not, shall remain the sole and exclusive property of AbMART.

AbMART makes no warranty, implied or otherwise, of fitness for a particular use of any item produced unless explicitly stated and AbMART will not be responsible for any consequential or other damages beyond the replacement or refund of purchase price of AbMART product or service, at our discretion. Due to the nature of our service work, we cannot guarantee successful results for the services requested by the customer expect for otherwise defined, understood and agreed by AbMART and the customer. Customer's exclusive remedy for non-conforming product shall be limited to replacement or an amount equal to the purchase price of the product or service. Customer agrees to indemnify and hold AbMART harmless and will reimburse AbMART for all costs related to any claim arising out of use of any AbMART product contrary to the terms contained herein or as specified in other current AbMART documentation.

All AbMART products are intended for in-vitro research use only and have not been cleared or approved by the U.S. FDA. Only those devices indicated as diagnostic products are to be used for diagnostic purposes in accordance with the instructions for use provided with the product.
